These website terms and conditions (Terms) apply to your use of www.playactivecollection.com (Site), owned and operated by Play Active Collection (ABN 59 141 592 610) (Play, we, us).

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, you must stop using the Site immediately.

We may update these Terms from time to time. Continued use of the Site means you accept the updated Terms. You should check this page periodically.

If you breach these Terms, we may suspend or terminate your access to the Site.

1. Intellectual Property

All content on the Site — including text, images, graphics, logos, audio, video, design layouts and software (Content) — is owned by Play or our licensors and is protected under Australian and international copyright law.

for unlawful, fraudulent or harmful purposes;
to interfere with the functionality or security of the Site;
to upload or distribute harmful, abusive, obscene or defamatory content; or
to attempt to bypass any security features.

If you create an account or place an order, you must:

provide accurate and current information;
keep your login secure; and
promptly update your details if they change.

We may cooperate with law enforcement if unlawful activity is suspected.

3. Third-Party Links

The Site may contain links to external websites (Linked Sites). We do not control, endorse or warrant these Linked Sites and are not responsible for their content, accuracy or security. Accessing Linked Sites is at your own risk.

4. Privacy & Data

Our Privacy Policy forms part of these Terms and explains how we collect, use and store your personal information.

We may update our Privacy Policy at any time.
We do not sell your personal data.

5. Gift Cards & Credit Notes

Valid for 3 years from purchase.
Redeemable online only.
Not redeemable for cash.
No discounts may be used to purchase Gift Cards.
If redeemed and items are returned, credit will be re-issued as store credit.
Remaining balances must be paid using accepted payment methods.
Play is not responsible for lost, stolen or incorrectly-addressed gift cards or credit notes.

We may cancel any Gift Card or Credit Note if misuse is suspected.

6. Promotional Codes

Only one promotional code may be used per transaction.
No cash alternative.
Not valid with other offers unless stated.
Must be applied at checkout — cannot be applied retrospectively.
Codes may be cancelled or refused at our discretion.

7. Competitions & Promotions

From time to time we may run promotions or competitions.
Additional competition-specific terms apply and form part of these Terms.

Unless stated otherwise:

entrants must be Australian residents aged 18+; and
promotions may have conditions around eligible products, timing and minimum spend.

8. SMS / Mobile Messaging (if applicable)

By opting in to our mobile messaging service, you agree to receive marketing and transactional text messages. Standard message and data rates may apply.

You may unsubscribe at any time using the link provided.

9. Accuracy of Information

We aim to ensure product information is accurate, but errors may occur.
Colours, sizing and fit may vary from how they appear on your device.

We may:

update product information without notice;
refuse or cancel orders where product information is incorrect.
If cancelled, you will receive a refund.

10. Australian Consumer Law

Our goods come with guarantees under the Australian Consumer Law (ACL) that cannot be excluded.
You are entitled to a replacement or refund for a major failure.
Nothing in these Terms excludes your statutory rights.

11. Disclaimer

The Site and Content are provided “as is.”
We do not warrant:

uninterrupted access;
that the Site is error-free or virus-free; or
the accuracy or completeness of Content.

12. Limitation of Liability

You indemnify Play against all losses, liabilities and expenses arising from:

your breach of these Terms.

14. Force Majeure

We are not liable for delays or failure to perform obligations due to events beyond our reasonable control.

15. Assignment

We may assign or transfer our rights under these Terms.
You must not assign your rights without our written consent.

16. Governing Law

These Terms are governed by the laws of Queensland, Australia.
You submit to the exclusive jurisdiction of the courts of Queensland.

17. International Use

The Site is intended for use in Australia. If you access the Site from overseas, you are responsible for complying with local laws.
